Agreement to these terms

These Terms of Use ("Terms") are an agreement between you and Bluumii ("we," "us" or "our"). By using bluumii.com, submitting a sample application or opting in to our text messages, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the site.

Who can use the site

Our site is for businesses. You must be at least 18 years old and authorized to act for the business you represent. You agree that the information you give us is accurate and complete.

Sample applications

Submitting an application does not guarantee a sample, an account or any business relationship. We review each application and decide, at our sole discretion, which stores receive samples. Becoming a customer may require additional information and a separate agreement. Any sale is governed by the terms we agree to in writing with you at that time.

Product information

Fresh flowers are natural products. Varieties, colors, sizes and availability vary by season and supply, and photos on the site are for illustration only. We may change or discontinue products at any time.

SMS terms

Program. Bluumii Retailer Updates. When you opt in, for example by checking the SMS consent box on our sample application, you agree to receive text messages from Bluumii at the number you provided about your sample application, account, deliveries and customer care.

Message frequency varies. Message and data rates may apply.

Opt out: reply STOP to any message to stop receiving texts. You'll receive one confirmation and no further messages unless you opt in again.

Consent to receive texts is not a condition of applying for a sample or making a purchase. Carriers are not liable for delayed or undelivered messages. Supported carriers may change.

Your mobile information is handled under our Privacy Policy. We do not share mobile opt-in data or consent with third parties for marketing or promotional purposes.

Acceptable use

You agree not to:

Use the site for anything unlawful, or submit false or misleading information
Interfere with the site's security or operation, or try to gain unauthorized access
Use bots, scrapers or other automated tools to collect content or data from the site
Upload or send anything harmful, such as viruses or malicious code

Intellectual property

The site and its content, including the Bluumii name and logo, text, photos and design, belong to Bluumii or its licensors and are protected by law. You may view the site for your own business purposes. You may not copy, modify or reuse our content without our written permission.

Links to other sites

Our site may link to sites we don't control. We aren't responsible for their content or practices.

Disclaimers

The site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the site will be uninterrupted, error-free or free of harmful components, and we don't guarantee any particular sales or business results.

Limitation of liability

To the fullest extent the law allows, Bluumii and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or our text messages. Our total liability for any claim related to the site will not exceed one hundred U.S. dollars ($100). Some jurisdictions don't allow these limits, so they may not fully apply to you.

Indemnity

You agree to defend and hold harmless Bluumii from claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

Changes to these terms

We may update these Terms from time to time. We'll post the new version on this page and update the effective date above. Continuing to use the site after a change means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms and our Privacy Policy are the entire agreement between you and us about the site.
